Terms of Service
1. Introduction and Scope of Agreement
General Provisions: These Terms of Service (the “Terms”) govern the use of the Student Bridge platform – an online marketplace connecting international student tenants (“Students” or “Tenants”) with local property owners (“Owners”) for medium- and long-term rentals. By registering or using the Student Bridge platform, you accept these Terms and all other policies referenced herein.
Platform’s Role: Student Bridge acts solely as an intermediary, facilitating communication, listing postings, and booking arrangements between Owners and Students. The platform itself is not an owner and does not offer or rent any accommodations. Any rental agreement concluded through Student Bridge (a “Rental Agreement”) is exclusively between the Owner and the Student – Student Bridge is not a party to that agreement.
Applicability of Local Law: Rentals arranged via Student Bridge are subject to the laws and regulations of the jurisdiction where the property is located. Currently, all properties on the platform are located in Poland, so Polish law applies to those tenancies.
Acceptance and Changes: By using the Student Bridge platform, you accept these Terms as a binding agreement. Student Bridge may update the Terms to reflect changes in law or in our services and will notify users of material updates before they take effect (e.g., by email or a platform notice). Continued use of the platform after the effective date of updated Terms constitutes acceptance of the changes. If you do not agree to the changes, you must stop using the platform and may close your account.
2. Definitions
Platform / Student Bridge: The website operated by Student Bridge (a business registered in Poland) through which Users can post, search for, and book accommodation listings. The Platform provides tools to facilitate the formation of Rental Agreements but is not a party to the Rental Agreement between Users.
User: Any natural or legal person using the Student Bridge platform, including both Students (Tenants) and Owners (Landlords). A User must be at least 18 years old and have full legal capacity to enter binding agreements.
Owner (Landlord): A User who offers accommodation for rent through the platform. An Owner can be an individual or a legal entity and must have the right to rent out the given property. Owners are responsible for ensuring that their listings comply with all applicable laws (including housing standards, zoning rules, and tax regulations).
Student (Tenant): A User (typically an international student) seeking accommodation for rent through the platform. In most cases, Students use the platform as consumers, entitled to protections under consumer protection laws by Polish and EU regulations.
Listing: An accommodation offer posted on the platform by an Owner, including apartments, rooms, or other premises intended for medium- or long-term stay. Each Listing contains information provided by the Owner (such as location, description, rent amount, deposit amount, available dates, and house rules). Owners bear sole responsibility for the truthfulness and legality of their Listings.
Booking Request: Student Bridge offers two booking modes. In the “Immediate Booking” option, the Owner has pre-signed a standard Rental Agreement. When a Student selects such a Listing, the Student first pays the required amounts (rent for the first month, deposit, and Service Fee), then signs the Rental Agreement, and the booking is confirmed immediately. In the default “Standard Booking” option, the Student submits a Booking Request that the Owner must confirm. Upon confirmation, the Student is required to pay the first period’s rent, deposit, and Service Fee, after which the Student signs the Rental Agreement and the Owner countersigns it. The booking becomes binding only when both parties have signed the Rental Agreement.
Standard Booking: The default booking process used for most listings. The Student submits a Booking Request that the Owner must confirm. Once confirmed, the Student pays the required amounts (first period’s rent, deposit if applicable, and the Service Fee), then signs the Rental Agreement. The Owner countersigns in return, and the booking becomes binding only when both parties have signed.
Immediate Booking: A booking option available for certain listings where the Owner has pre-signed the standard Rental Agreement. When a Student chooses an immediate booking, the Student pays the required initial payment (including rent, deposit, and Service Fee), then signs the Rental Agreement. Because the Owner’s signature is already in place, the booking is confirmed immediately upon the Student’s signature.
First Payment (first month’s rent): The initial payment, comprising the rent for the first rental period, the required security deposit, and the Student Bridge Service Fee (if applicable). Student Bridge (through an external payment processor) collects this payment on behalf of the Owner as a limited collection agent. The funds are held in the Student Bridge account (escrow) and released to the Owner only after the Student moves in and the Tenant Protection Period passes without any justified complaints.
Service Fee: A fee charged by Student Bridge for use of the platform. It may apply to Students, Owners, or both. For Students, it is typically a one-time fee (a flat amount or a percentage of one month’s rent) added during booking finalization. For Owners, it may be a commission deducted from the payout (for example, a percentage of the first month’s rent). All applicable Service Fees are disclosed upfront on the platform. As a rule, Service Fees are non-refundable after a booking is confirmed, unless expressly provided otherwise in these Terms (e.g., in certain cancellation scenarios described in Section 9).
Rental Agreement: The lease agreement for the premises entered into between the Owner and the Student regarding the offered accommodation. Student Bridge provides a lawyer-drafted bilingual template Rental Agreement (Polish-English) that is used for all bookings made through the platform (see Section 7). This agreement is entered into exclusively between the Owner (lessor) and the Student (lessee), sets out the terms of the tenancy (such as rent, duration, deposit, and rules for the premises), and becomes legally binding once signed by both parties.
Tenant Protection Period: A short period after move-in (currently 48 hours) during which Student Bridge holds the First Payment in its account to ensure the accommodation meets the listing description. If the Student reports a significant issue with the accommodation during this period (for example, the property was misrepresented or is uninhabitable), the report will be handled according to Section 9, and the Student may be eligible for a refund or cancellation. If no justified objections are raised within 48 hours of the move in date, the First Payment is released to the Owner. (If the Student chooses to authorize an earlier release of funds to the Owner, those funds are no longer covered by the above protection.)
3. Platform Services and Role
Platform functionality: Student Bridge provides an online marketplace that connects Owners and Students. Owners can create property listings with details and photos, and Students can search for accommodations that meet their criteria. The platform facilitates the initial booking process by allowing Students to send Booking Requests and enabling Owners to accept or reject those requests. When a booking is confirmed, Student Bridge initiates the formation of a formal Rental Agreement between the parties, as described in Section 7.
Booking process and communication: All initial inquiries, booking negotiations, and confirmations must take place through the Student Bridge platform. Users’ direct contact information (such as phone number or email address) will not be shared before a booking is confirmed. The platform is designed to protect Users by keeping communication on-platform during the booking stage. Users are expressly prohibited from circumventing the platform by attempting to arrange rentals or payments outside of Student Bridge. For example, a User may not attempt to avoid paying Service Fees by entering into a private agreement outside the platform. Such action constitutes a serious breach of these Terms and may result in suspension or removal of the account (see Section 13) and liability for damages.
Secure payment handling: Student Bridge uses an external payment processor (currently Stripe) to handle all payments, which are held in the Student Bridge account until the Student moves in and the 48-hour Tenant Protection Period passes without complaint. Payout to the Owner occurs only after that period, unless the Student explicitly authorizes earlier release of funds through the platform’s secure system. Any early release of funds must be confirmed within the platform; off-platform communication (e.g., email or phone) will not be recognized for this purpose. Once funds are released, they are considered paid out to the Owner and are no longer covered by refund protection.
Additional services: Student Bridge may offer supplemental services to facilitate the rental process. These can include customer support in communications, help organizing property viewings (in person or virtual), translation support, or providing a standard digital Rental Agreement and electronic signature service (see Section 7). Any such additional services are provided to assist Users but remain subject to these Terms and any specific conditions provided at the time of using those services. Student Bridge does not guarantee the availability of any supplementary services, and their scope may change as the platform is updated.
Platform availability: We strive to keep the Student Bridge platform running smoothly and securely, but we cannot guarantee uninterrupted service. The platform may periodically be unavailable due to maintenance, updates, or unexpected technical issues. Users are not entitled to continuous, error-free availability of the platform. However, Student Bridge will make commercially reasonable efforts to inform Users of significant downtimes or changes that might affect service usage. We maintain industry-standard security and performance measures to protect the integrity of the service.
Integration with third-party services: Student Bridge integrates certain third-party tools and services to provide secure payments and other platform features — for example, Stripe, Inc. (used for payment processing and, if needed, identity verification) or electronic signature platforms. By using these integrated features, Users also agree to the terms of service of those third parties. Although Student Bridge chooses reputable providers and exercises due care in integration, it is not liable for failures or issues caused by external services. In the event of a third-party service failure, Student Bridge will assist in resolving the issue to the extent possible or provide an alternative solution.
4. User Registration and Accounts
Account creation: To list a property or send a Booking Request, a User must first create an account on the Student Bridge platform. Registration requires providing accurate and up-to-date information, including name, contact details, and (for Owners) property or business information if required. Each individual or entity may register only one account, and accounts are non-transferable. By registering, you represent that you are at least 18 years old and have full legal capacity. You agree to keep your account information current and truthful at all times.
Account security: You are responsible for maintaining the confidentiality of your account login credentials. Do not share your password or allow others to use the platform through your account. If you suspect unauthorized use of your account or any security breach, you must notify Student Bridge immediately. We may ask you to reset your password or undertake additional verification to secure the account. Student Bridge is not liable for any loss or damage resulting from unauthorized use of your account if you have failed to safeguard your authentication data.
Profile requirements: After registration, Users may be required to complete a profile. Students may be asked to provide information confirming their student status (e.g., an admission or enrollment letter), and Owners create profiles for themselves and their property listings. All information provided in profiles or listings must be truthful and not misleading. Misrepresenting identity, qualifications, or property details can result in suspension or removal of the account (see Section 13). Profiles and listings should be kept updated so that all information remains accurate.
Owner status – consumer or entrepreneur: Owners may declare whether they are acting as private individuals (consumers) or as businesses/professionals when listing a property. Student Bridge may display the Owner’s status (e.g., “Private Owner” or “Professional Owner”) to inform Students, in accordance with legal requirements.
Privacy and data consent: By registering with Student Bridge, you acknowledge and agree that your personal data will be collected and processed as described in our Privacy Policy. This includes the use of your data for identity verification, facilitating bookings, processing payments, and other purposes necessary to provide the service. We process personal data in compliance with the EU General Data Protection Regulation (GDPR) and applicable Polish data protection laws. Section 12 of these Terms provides a summary of our data protection practices. By creating an account, you consent to receive service-related communications from us (such as booking confirmations or account notifications). You may withdraw your consent and request account deletion at any time, as described in Section 12 and the Privacy Policy, but this will prevent further use of the platform.
5. Posting Listings and Owner Obligations
Creating and managing listings: An Owner may create a Listing by providing all required details about the property, including address, description, photos, rental price, additional fees (and what they cover), deposit amount, available dates, minimum rental period, and any special terms or house rules. By posting a Listing, the Owner certifies that all provided information is accurate, current, and not misleading. The Owner should promptly update the Listing if any details change (for example, if the property becomes unavailable or rental terms change). Inaccurate or outdated listings may lead to booking cancellations and constitute a breach of these Terms.
Verification of Owners and properties: To promote safety and trust, Student Bridge may verify the identity of Owners and certain information about their properties. Verification may include requiring the Owner to provide identification, proof of ownership or right to rent the property (e.g., a title deed or the owner’s consent in case of sublease), and confirmation of contact details. Upon request, the Owner must promptly provide such documents or information. Student Bridge may mark a Listing as “Verified” after completing key verifications (for example, confirming the Owner’s identity and that they have demonstrated the right to offer the property). Failure to comply with verification requests may result in suspension or removal of the Listing or the Owner’s account.
Limitations of “Verified” label: A “Verified” label on a Listing (or Owner profile) means that Student Bridge has checked certain information (such as identity, existence of the property, and proof of ownership or permission to rent). While verification aims to reduce fraud risk and increase trust, it is not a guarantee by Student Bridge regarding the property’s condition or suitability. Conditions can change over time, and not every aspect of a property can be verified. Owners remain fully responsible for the accuracy of their Listings and for ensuring the property matches the description and can be legally rented. Students should still exercise due caution (e.g., by reading reviews or asking questions) even if a Listing is marked as verified.
Accuracy and duty to disclose: The Owner must describe the accommodation accurately and disclose all important terms or restrictions. This includes, for example, whether utilities are included in rent, any additional fees (e.g., maintenance charges), and specific rules (e.g., no pets, no smoking, quiet hours, guest limitations, presence of security cameras, etc.). Omitting key information or presenting the property in a misleading way can lead to disputes and constitutes a breach of these Terms. Student Bridge may remove or require correction of Listings that prove to be materially misleading or incomplete.
Right to rent: By posting a Listing, the Owner confirms that they have the right to rent out the property to others. For example, if the Owner is themselves a tenant or a co-owner, they have obtained all necessary permissions (from the property owner, co-owners, etc.) to sublet or rent out the premises. The Owner must ensure that offering the accommodation for a medium- or long-term through the platform does not violate any agreements (such as their own lease or homeowners association rules) or laws. Student Bridge does not assume responsibility for verifying an Owner’s authority to rent the property. However, if we become aware that an Owner is renting out a property without proper authorization or in violation of law, we may remove the Listing, and the Owner bears sole responsibility for any consequences (legal or financial) arising from such improper rental.
Content license and ownership: Owners may add photos, descriptions, and other content when creating a Listing. By providing content on the platform, the Owner grants Student Bridge a non-exclusive, royalty-free license to use, reproduce, edit, and display that content on the platform and in promotional materials. This license is solely to allow the operation and promotion of the platform. Owners should only upload content they have the right to use. You must not upload images or text that infringe on others’ copyrights or intellectual property. If Student Bridge offers assistance to Owners (e.g., professional photography or translation services for a listing), ownership and permissible use of such materials will be specified separately — typically such content may belong to Student Bridge or be provided to the Owner solely for use on the platform.
Permitted properties and restrictions: Student Bridge is intended for long-term student housing rentals, not short-term vacation rentals or hotel stays. Owners may only post residential properties suitable for student occupancy. You may not post any property that you are not authorized to rent, nor use the platform to promote a listing only to redirect Students to another service or off-platform listing. Student Bridge reserves the right to remove any Listing that violates these Terms or applicable law, or that we determine is inconsistent with the purpose of the platform (for example, if the listing is essentially a short-term tourist rental, or if we suspect fraud or unlawful intent). Additionally, an Owner may not use the platform to circumvent tenant protection laws; any attempts to use Student Bridge for illegal evictions or tenant discrimination will result in removal from the platform.
6. Booking Process and Payment Terms
Submitting a Booking Request: When a Student finds a suitable Listing, they can send a Booking Request through the platform, indicating a preferred move-in date and – if required by the Owner – the intended rental period. Each Listing may specify a minimum or fixed rental term (e.g., a minimum of twelve months). By submitting a Booking Request, the Student expresses a commitment to rent the accommodation under the terms set out in the Listing (including meeting any minimum rental period requirement and abiding by the property’s rules). A Booking Request constitutes an offer by the Student to enter into a Rental Agreement; it is not confirmed until the Owner accepts it. Owners are expected to respond to Booking Requests within the timeframe specified by the platform (for example, within 48–72 hours); if the Owner takes no action, the request may expire automatically.
Booking confirmation: A booking is confirmed when the required payment has been made and the Rental Agreement duly signed according to the booking method used. In the “Immediate Booking” option, the Owner has pre-signed the Rental Agreement; the Student pays the required amounts (first period’s rent, deposit if applicable, and the Service Fee), then signs the agreement, and the booking is confirmed at once. In the “Standard Booking” option, the Student submits a Booking Request that the Owner must confirm; then the Student makes the payment, signs the Rental Agreement, and the Owner countersigns it – at which point the booking becomes binding. After a booking is confirmed, Student Bridge provides the parties with each other’s contact details so they can arrange handover of the premises, and the platform provides electronic storage of the Rental Agreement. Owners must not ask for or accept any initial payments outside the platform.
Payments: Student Bridge processes payments using secure external providers. By providing payment information and booking an accommodation, the Student authorizes Student Bridge to charge the indicated amounts. The First Payment collected upon booking confirmation is held by Student Bridge in an account. By default, the funds will be transferred to the Owner after the Student moves in and a 48-hour Tenant Protection Period passes without the Student reporting any significant issues (see problem handling procedure in Section 9.3). If the Student raises a justified issue within the first 48 hours after move-in, Student Bridge may hold the funds and delay or cancel the payout to the Owner until an investigation is conducted (and potentially refund the Student, in line with the policies in Section 9). As noted, the Student has the option to waive the protection period and authorize earlier release of funds to the Owner (for example, when booking is made months in advance and the Owner requires upfront payment to secure the booking). Early release of funds must be confirmed on the platform by the Student, and once approved, those funds are under the Owner’s control as with a direct payment, meaning they will not be covered by the 48-hour post-move-in refund policy.
Fees and commissions:
Service Fee (Student): Students may be charged a Service Fee when making a booking. This fee is displayed during the checkout process before payment. It is often calculated as a percentage of one month’s rent or as a flat amount, and it covers use of the platform, including services like secure payment processing and customer support. Unless these Terms or a specific promotion provide otherwise, the Service Fee paid by the Student is non-refundable after booking confirmation (the only exceptions are if the booking is later canceled by the Owner or if a qualifying issue under Section 9 results in a full refund).
Commission (Owner): Owners may be charged a fee for each completed booking, usually in the form of a commission deducted from the first payout. For example, Student Bridge may deduct a specified percentage from the first month’s rent (or from the total booking value) as the Owner’s fee for using the platform. The platform will automatically deduct such commission before transferring the payout to the Owner. After each payout for a booking, Student Bridge will provide the Owner with a statement or invoice itemizing any fees deducted. Owners are responsible for any taxes applicable to the Service Fee (for example, if VAT applies to the fee, it will be added as required and indicated on the invoice).
Security deposits: If the Owner requires a security deposit (as indicated in the Listing and the Rental Agreement terms), the platform may facilitate collection of that deposit as part of the First Payment. By default, any deposit paid through the platform will be held in the Student Bridge account along with the first month’s rent and released to the Owner 48 hours after the Student moves in, provided the Student does not raise any dispute or issue. The Student may also authorize earlier release of the deposit to the Owner under the same conditions as early rent release. Once the deposit amount is released to the Owner (whether after the Tenant Protection Period or earlier at the Student’s request), Student Bridge’s involvement in handling that deposit ends. The deposit is then subject to the Rental Agreement and applicable law. From that point, the Owner is responsible for holding the deposit and its eventual return to the Student at the end of the tenancy, taking into account any legally permissible deductions for damages or unpaid rent as per the Rental Agreement.
Currency and foreign exchange: By default, transactions on Student Bridge are conducted in Polish złoty (PLN). The platform may allow Users to see approximate prices in other currencies for convenience, but the actual charge and payout will be in PLN (unless explicitly specified otherwise at booking). If a Student’s payment method is in another currency, the Student’s bank or card issuer will handle currency conversion at their own rate and may charge conversion fees. Similarly, an Owner receiving a payout to an account in a currency other than PLN may incur conversion costs charged by their bank. Student Bridge is not responsible for any differences caused by currency conversion or bank fees. The PLN amount specified at booking is the final transaction price. Any displayed equivalent in another currency is an estimate and may differ from the final amount charged by the User’s financial institution due to exchange rate fluctuations or fees.
Receipts and documentation: After a successful payment for a booking, the Student will receive an electronic payment confirmation (receipt or confirmation) by email. The Owner will receive notification of the initiated payout, along with an invoice for any platform fees or commissions that were deducted. Users can also access their booking and transaction history in the Student Bridge account dashboard. It is the Users’ responsibility to retain copies of these documents. A Student may need proof of payment for the accommodation for purposes such as visa applications or scholarship accounting, and an Owner must maintain documentation for accounting and tax purposes. Student Bridge will retain transaction records in accordance with our data retention policy (and legal requirements), but Users are advised to keep their own copies of all important documents and correspondence.
7. Rental Agreement and Electronic Contracting
Standard bilingual Rental Agreement template (Polish-English): To streamline the rental process and ensure compliance with Polish law, Student Bridge provides a standard Rental Agreement template, which is bilingual (in Polish and English). This “Student Bridge Rental Agreement Template” contains key provisions required by Polish tenancy law and an English translation for convenience. Use of this standard template is mandatory for all bookings made through the platform; Owners may not substitute their own contract documents when entering the initial agreement. The template will automatically include the specific details of the transaction (such as the parties’ names, property address, rent amount, deposit, rental period, and move-in date) based on the Listing and booking details. Both parties will have the opportunity to review the content of the agreement populated with their details before signing.
Electronic signature and legal effect: Student Bridge offers a digital signature feature that allows the Owner and Student to sign the Rental Agreement online through the platform interface. The e-signature process complies with applicable electronic signature laws, including the EU eIDAS regulation, meaning the electronic agreement is legally valid and enforceable. By proceeding with an online booking, Users agree to sign the Rental Agreement electronically. Once both the Owner and the Student have applied their electronic signatures to the agreement on the platform, the Rental Agreement is considered concluded and binding, just as if it had been signed on paper.
Bilingual contract and interpretation: The text of the Rental Agreement is available in both Polish and English. Both language versions are intended to be equivalent in meaning. However, because the tenancy takes place in Poland and Polish law applies, in the event of any discrepancy or dispute over interpretation, the Polish version of the agreement takes precedence. The English translation is provided to help Students who are not fluent in Polish.
Storage of the agreement: After the Rental Agreement is signed electronically by both parties, a PDF copy of the signed document will be stored on the platform. Both the Owner and the Student will be able to download this copy for their records. Student Bridge will keep a copy for a defined period (for example, for the duration of the tenancy and any required archival period), mainly for record-keeping purposes and to provide a backup copy if needed by either party. Nevertheless, each party is responsible for saving and storing their own copy of the agreement. Document storage by Student Bridge is not an indefinite archive, and we may delete older documents in accordance with our data retention policy.
Changes to rental agreement terms: After the Rental Agreement is signed, Student Bridge does not automatically generate or handle contract amendments. If the Owner and Student agree to changes in the tenancy terms (e.g., a rent adjustment or other provisions), they must document those changes on their own in accordance with applicable law, unless the platform provides a specific feature to facilitate such changes.
Platform not a party to the agreement: Student Bridge is not a party to the Rental Agreement and is not responsible for enforcing its terms. The Rental Agreement is made exclusively between the Owner and the Student. Student Bridge’s role ends with providing the contract template and e-signature service. We do not mediate disputes arising from the Rental Agreement, provide legal advice on obligations under it, or guarantee performance of either party’s obligations. Any issues that arise during the tenancy (such as repairs, early termination, deposit return, or breaches of the agreement) must be resolved between the Owner and the Student in accordance with the agreement and applicable tenancy law. The only role of the platform in post-signing issues may be limited to what is described in Section 9 (for example, if a serious misrepresentation is discovered immediately upon move-in) or to facilitating communication if both parties request our help. Otherwise, disputes must be resolved through the procedures outlined in the Rental Agreement or through legal means, not through the platform.
8. Acceptable Use Policy
Use of the platform as intended: Users must use Student Bridge solely for the purpose of searching for or offering accommodations and related services via the platform’s provided procedures. All communication regarding bookings and the initial rental payment must occur through Student Bridge. Obtaining or sharing contact information to arrange a booking off-platform is prohibited. For example, Owners should not include private email addresses, phone numbers, or links to external sites in listings in an attempt to conduct transactions outside the platform. If we determine that a User is attempting to circumvent the platform (to avoid fees or for any other reason), Student Bridge may take action, including warning the User, canceling bookings, or removing the account (see Section 13). These rules ensure a fair marketplace and the safety of our Users.
Content standards: Users are responsible for all content they post (including profiles, listings, and messages). Content must be truthful, lawful, courteous, not misleading, and free from discrimination, harassment, obscenity, intellectual property infringement, spam, or harmful code. Listings must remain related to the offered accommodation and may not be used for unrelated promotions. Student Bridge may edit, remove, or block any content that violates these standards, applicable law, or in response to justified complaints (e.g., regarding copyright infringement).
Platform integrity and security: Users may not disrupt or compromise the security of Student Bridge. Prohibited actions include unauthorized access, using bots or scraping tools, introducing harmful code, overloading the system, or attempting to reverse engineer the platform. Violations may result in immediate account removal and legal action.
Proper use: The platform is intended for real individuals (Students and Owners) to engage in genuine rental transactions. It must not be used for any other commercial purposes without consent. For example, a Student may not use the service to advertise their own services or recruit for unrelated programs, and an Owner may list only properties that they personally own or manage (and may not act as an unlicensed agent for third parties, unless explicitly allowed and fully transparent). Subletting via the platform is allowed only if it is legal and has required permissions (and the person posting the listing then effectively acts as the “Owner” for purposes of these Terms and is responsible for the listing). Any other use of the platform that deviates from the goal of connecting students with housing offers may be considered abuse.
Compliance with laws: Users must comply with all applicable laws while using Student Bridge, including those concerning rentals, consumer protection, anti-discrimination, data protection, and prevention of financial fraud. Owners are responsible for lawful rental practices (deposits, tenant registration, taxes, etc.), and Students must adhere to visa regulations or local registration requirements. Misuse of personal data, discriminatory listings, or illegal transactions are strictly forbidden. Student Bridge may suspend accounts, remove content, or report violations to authorities if required.
User obligations off-platform: Although Student Bridge facilitates contact and agreement formation, Users are responsible for their conduct off-platform. Owners must provide the accommodation as agreed, in a safe and habitable condition. Students must treat the property respectfully and abide by the terms of the Rental Agreement. Student Bridge does not supervise in-person interactions or property condition. However, if we receive reports of misconduct (for example, harassment, theft, property damage, etc.), we may investigate and take appropriate action regarding the platform account (such as warnings or account removal). Serious incidents may also be reported to law enforcement or appropriate authorities.
Consequences of violations: A violation of this Acceptable Use Policy or any part of these Terms may result in a range of actions by Student Bridge. We may issue a warning, require corrective actions (such as updating incorrect information), remove offending content, cancel bookings, or suspend/remove a User’s account. In serious cases, especially involving illegal activities, fraud, or safety threats, action may be taken immediately and without prior notice – including instant account or listing removal. If an account is removed due to misconduct, the User is not entitled to any refund of Service Fees, and all pending bookings may be canceled with penalties as per Section 9. Additionally, Student Bridge reserves the right to pursue legal claims for prohibited activities conducted via the platform.
9. Cancellation and Refund Policies
9.1 Cancellation by Student (Tenant):
24-hour free cancellation period: After a booking is confirmed (i.e., the Owner has accepted the request and payment has been made), the Student has a 24-hour window to cancel for any reason and receive a full refund of the paid rent and deposit. The Student Bridge Service Fee paid by the Student is generally non refundable; however, if the Student cancels within this 24-hour protection period, Student Bridge may, at its discretion, refund the Service Fee or credit it for use on a future booking on the platform.
Flexible cancellation policy (after 24 hours): If more than 24 hours have passed since booking confirmation, the following rules apply for cancellations by the Student before move-in:
- More than 30 days before the move-in date: The Student will receive a full refund of the first
month’s rent (and any collected deposit). The Service Fee remains non-refundable (aside from the possibility of crediting it to a future booking). - 30 to 7 days before the move-in date: The Student will receive a 50% refund of the first month’s rent (and an equivalent portion of any deposit). The Service Fee remains non-refundable (aside from the possibility of crediting it to a future booking).
- Less than 7 days before the move-in date: The first month’s rent is non-refundable if the Student
cancels on short notice (within the week before move-in), except at Student Bridge’s discretion in the event of extraordinary circumstances (see below). The Service Fee remains non-refundable (though it may be credited for future use).
Extraordinary circumstances: If the Student cancels a confirmed booking due to unforeseen and significant events beyond their control — such as serious misrepresentation or unavailability of the accommodation, visa refusal or not being admitted to the university, or other cases that Student Bridge deems justified (supported by appropriate documentation) — Student Bridge may waive the standard cancellation policy and provide up to a full refund of rent and deposit, as well as refund or credit the Service Fee.
No-show by Student: If the Student does not show up or take possession of the accommodation on the agreed move-in day and does not notify the Owner or Student Bridge of a cancellation within the first 48 hours after the scheduled move-in, it will be treated as a cancellation by the Student. In such a scenario, the booking will be canceled, the Owner will receive the first month’s rent (because they held the accommodation for the Student), and the Student will not receive a refund. Note that this rule concerns the settlement of funds via the platform; it does not terminate the signed Rental Agreement between the Owner and the Student. The Rental Agreement may still be in effect under the law, meaning the Owner could potentially seek further rent or damages from the Student for breach of contract through normal legal proceedings. (In practice, both parties may agree to terminate the agreement, but that is outside the scope of the platform’s involvement.)
9.2 Cancellation by Owner:
Cancellation initiated by Owner: If the Owner cancels a confirmed booking before the Student’s move-in (e.g., if the Owner withdraws the property from rental or the property becomes unavailable due to unforeseen circumstances), the Student will receive a full refund of all amounts paid, including rent, deposit, and the Service Fee. Student Bridge will assist the Student, as far as possible, in finding alternative accommodation on the platform, but cannot guarantee a replacement listing.
Penalties for cancellation by Owner: If an Owner cancels a booking without a valid reason, Student Bridge may impose penalties such as cancellation fees up to the amount of the Service Fee, automatic negative reviews, reduced visibility of listings, or suspension/removal of the account in cases of repeated or serious violations. Owners will be informed of any penalties imposed.
Last-minute cancellation (within 14 days of move-in): If an Owner cancels a booking less than 14 days before the agreed move-in date, this is especially disruptive for the Student. In addition to a full refund for the Student, Student Bridge may (but is not obligated to) provide the Student with additional support, such as reimbursing the cost of temporary accommodation (e.g., a few nights in a hotel or hostel, up to a reasonable nightly rate). Such assistance is a goodwill gesture by Student Bridge and does not constitute an assumption of any liability or guarantee; it is solely intended to help the Student cope with the sudden situation and to impose on the Owner a penalty equal to the Service Fee amount.
No-show by Owner or failure to provide accommodation: If the Owner or their representative fails to meet the Student or otherwise fails to give the Student access to the accommodation on the move-in day (and the Student has not canceled the booking), it will be treated as a cancellation by the Owner. In such a case, the Student should contact Student Bridge as soon as possible. The Student will receive a full refund of all payments made, and Student Bridge will treat this as a serious violation by the Owner. The Owner will be subject to the same penalties as for a cancellation, and potentially additional liability if the Student incurred expenses (for example, if the Student traveled to the city to move in and had to stay in a hotel due to the Owner’s failure). Student Bridge reserves the right to charge the Owner a penalty equal to the Service Fee and such costs, or to seek their reimbursement on the Student’s behalf, although the primary recourse for the Student may ultimately be legal action under the Rental Agreement.
9.3 Move-in Protection (48-hour window):
Initial inspection period: Student Bridge provides a 48-hour protection window starting from when the Student’s Rental Agreement takes effect (typically the move-in date) to allow the Student to verify that the accommodation matches the listing. The Student should inspect the property promptly upon arrival. If the Student discovers a significant issue that constitutes a breach of the Listing’s assurances or a serious defect (for example, the property was grossly misrepresented, is unsafe or uninhabitable), the Student must report it to Student Bridge within the first 48 hours.
Reporting problems: To report an issue, the Student should contact Student Bridge support (through the platform or via the provided email/phone) and provide details and evidence (e.g., photos) of the problem. “Significant issues” include situations such as: the property is materially different than described or pictured in the listing (e.g., different location or size), key utilities or amenities are missing or non-functional contrary to assurances (e.g., no running water or electricity), the property is unavailable (e.g., someone else is already living there or the Owner fails to provide keys), or conditions render the accommodation uninhabitable (severe mold, pest infestation, major structural problems, etc.).
Resolution procedure: Upon receiving a timely report, Student Bridge will hold the First Payment from being released to the Owner and investigate the claim. We may mediate between the parties to clarify issues. If a problem can be quickly resolved (for example, the Owner agrees to immediately fix a defect or adjust terms), the Student may choose to proceed with the tenancy. However, if Student Bridge verifies the issue and deems it a significant misrepresentation or violation by the Owner, the Student may opt to cancel the booking. In that event, the Student will receive a refund of the first month’s rent and any deposit paid, as well as the Service Fee, and the booking will be terminated. The Owner will not receive a payout and will be considered in breach of these Terms, and likely also the Rental Agreement.
Limitations: If the Student does not report any problems within 48 hours of the move-in date, the platform will release the funds to the Owner. After this time, any disputes or issues are considered outside the scope of the platform’s controlled refund policy and must be resolved between the Owner and the Student according to their Rental Agreement and applicable law. For example, if a maintenance issue arises two weeks after move-in, it is a normal matter for the landlord and tenant to resolve under the agreement. Also, if the Student chose to release the funds early (before move-in or before 48 hours elapsed), the platform’s ability to intervene with a refund is limited, as the Owner has already received the money. The 48-hour Student Bridge protection is intended as a safeguard for immediate move-in issues and does not extend beyond that initial period.
9.4 Refund process:
Method of refund: When a Student is entitled to a refund under these Terms (whether due to a permitted cancellation by themselves per the rules, an Owner’s cancellation, or a verified post-move-in issue), Student Bridge will issue the refund via the Student’s original payment method, if possible. Depending on the payment method (credit card, bank transfer, etc.), it may take a few business days for the refund to appear in the Student’s account due to banking processing times.
Treatment of Service Fee: As noted, the Student Bridge Service Fee is non-refundable in most cases of Student-initiated cancellation (aside from potential credit for future use). However, if a booking is canceled or terminated due to the Owner’s breach or decision (e.g., an Owner cancellation or a confirmed misrepresentation), then Student Bridge will also refund the Service Fee to the Student, since the Student did not receive the benefit of the booking. In such cases, the Owner may still be required to pay the Service Fee to Student Bridge, because the platform provided its service up to the point of booking (we reserve the right to deduct it from amounts we hold from the Owner, or to charge the Owner via an invoice).
Adjustments to payouts: If funds have already been transferred to the Owner at the time a cancellation or refund is granted (for example, if an Owner’s cancellation occurred after the payout was made, or a Student’s complaint was verified after an early release of funds), Student Bridge will attempt to recover those funds from the Owner. The Owner agrees that Student Bridge has the right to deduct appropriate amounts from future payouts or to request repayment in such situations. Conversely, if the Owner is entitled to some portion of rent despite a cancellation (e.g., under the policies, the Student only gets a 50% refund due to a late cancellation), Student Bridge will ensure the payment of the appropriate amount to the Owner in accordance with the rules, from available funds.
Finality of decisions: Student Bridge’s decisions regarding refunds and payout adjustments under these Terms are final for transactions conducted through the platform. This means that if we determine that a Student is entitled to refund of amount X or an Owner should receive amount Y according to our payment policies, both parties agree not to challenge Student Bridge’s decision within the platform. However, this does not prevent the Student or Owner from pursuing their rights through legal means outside the platform. For example, if an Owner believes a Student’s claims were unfounded and they lost money due to a refund, the Owner could potentially pursue a claim against the Student for breach of the Rental Agreement or other damages in court. Student Bridge will not reverse its transaction decision on the platform unless required to do so by a valid court judgment.
10. Consumer Rights and Withdrawal (EU)
Right to withdraw from platform services (14-day rule): Under EU and Polish law, consumers in some cases have the right to withdraw from distance contracts (such as accepting terms online) within 14 days without giving a reason. This Section explains how that right applies to the Student Bridge service. If you are a Student (or other User) acting as a consumer (i.e., using our service for personal purposes, not as a business), you have the right to cancel your contract with Student Bridge (the agreement to use our platform) within 14 days from the day you accepted these Terms or otherwise entered the agreement, provided that we have not yet fully performed our services within that period. This right of withdrawal is not the same as canceling a booking; it pertains to withdrawing from the contract for use of the platform service itself. If you exercise this right, it generally means your account will be closed and you will receive a refund of any Service Fees you may have paid.
Waiver of withdrawal right for immediate service performance: If you wish to begin using Student Bridge’s services immediately (for example, you register and promptly send booking requests or confirm a booking within this 14-day withdrawal period), you are effectively asking us to begin providing our intermediary service at once. In such cases, you acknowledge that once Student Bridge has fully performed the requested services (i.e., a booking is confirmed and we have facilitated the connection and payment), you lose the right to withdraw from the platform services contract. In practice, this means: when you confirm a booking during this 14-day period, our service (connecting you with an Owner and facilitating the Rental Agreement) has been delivered. You can no longer withdraw from the platform services contract to get a refund of the Service Fee, because the service you requested from us has been completed. We may ask you for explicit confirmation of this (for instance, by checking a box acknowledging the waiver of the right to withdraw once the service is fully performed) when making a booking.
How to exercise the 14-day withdrawal right (service contract): If you register on Student Bridge, and then decide within 14 days that you do not want to use our platform services, you can inform us (by email to our support address or another indicated contact method) that you are exercising your right to withdraw from the contract. You do not need to provide a reason. We will then close your account. If you have paid any Service Fees (and have not completed any booking), we will refund those fees to you. Note that if you have already completed a booking that is in progress or has been completed, our services are considered fully delivered and the withdrawal right no longer applies to those services.
Withdrawal does not apply to the Rental Agreement: The right described in this Section 10 applies only to the contract between you and Student Bridge (the contract to use the platform). It does not apply to the separate Rental Agreement you enter with an Owner.
11. Liability and Disclaimers
Platform provided “as-is”: Student Bridge provides the platform and services on an “as is” and “as available” basis, without any express or implied warranties except those explicitly stated in these Terms. While we strive to ensure the service operates safely and correctly, we do not guarantee that the platform will be available uninterrupted or error-free, or that all information (including listings) is accurate or up-to date. You use the platform at your own risk. For example, we do not warrant that any specific accommodation will meet your expectations or that the platform will be accessible at every moment.
No guarantee of accommodation quality: Student Bridge is not the owner or manager of the listed properties and cannot guarantee their condition, safety, or handover. All accommodation descriptions or photos on the platform are provided by Owners. Although we may conduct limited verifications (such as confirming identity or ownership, or occasional inspections), Student Bridge makes no warranty that a property will match its description. Owners are responsible for ensuring their listings are truthful and their rentals lawful (e.g., meeting building requirements or having rental permits). Students should be aware that any issues concerning the accommodation itself will need to be resolved with the Owner under the Rental Agreement (apart from situations covered by the initial 48-hour protection policy). A “Verified” status on a Student Bridge listing means certain facts were verified at a point in time (e.g., property ownership or identity), but it is not a general guarantee by the platform about every aspect of the property.
Limitation of liability: To the maximum extent permitted by law, Student Bridge is liable only for direct damages caused by our breach, gross negligence, or willful misconduct, and such liability is limited to the greater of: the total fees paid to us by the User, or the equivalent of one month’s rent for the booking in question. We are not liable for indirect or consequential damages (e.g., lost income, inconvenience, or stress), nor for actions or omissions of Users, false or misleading information provided by them, personal or property damage occurring during the tenancy, or technical problems such as outages, errors, or hacking attacks, unless directly resulting from our fault.
No rental insurance: Student Bridge is not an insurer of rental transactions. Apart from what is expressly promised in these Terms (e.g., certain refunds described in Section 9), we do not compensate Users for problems. For example, if a Student’s personal items are stolen or an Owner’s property is damaged, that is outside the scope of our platform’s obligations (though we encourage parties to have their own insurance if concerned about such risks). Owners should consider landlord insurance, and Students may consider renter’s insurance as appropriate.
Disputes between Users: If a disagreement or conflict arises between an Owner and a Student, Student Bridge is not legally responsible for resolving it. We may offer mediation or support to help the parties communicate, but the ultimate resolution (apart from situations covered by our controlled procedures like cancellations or the 48-hour policy) is up to the Owner and Student. Any legal disputes regarding the Rental Agreement, payments beyond the initial payment processed on the platform, deposit return, etc., are matters to be resolved under the Rental Agreement or applicable law. Users agree that they will not involve Student Bridge in legal proceedings or claims arising from issues between them, except where we have breached our own obligations set out in these Terms.
Release of claims: To the extent permitted by law, you agree that in the event of a dispute with another User, you release Student Bridge from all claims, demands, and damages of every kind arising out of or related to such dispute. For example, if you are a Student suing an Owner (or vice versa) for some reason, you cannot also claim that Student Bridge is liable just because you met the other party through our platform. This release does not cover any rights you have against us for our own failings (i.e., it does not apply if you have a claim that Student Bridge breached these Terms or was negligent on our part). It is meant to clarify that we should not be drawn into disputes between Users.
Indemnification: Users agree to indemnify and hold Student Bridge harmless from any claims, damages, or expenses (including legal costs) arising from their breach of these Terms, violation of law or third-party rights, off-platform actions related to the platform, or other improper conduct. Owners acting as businesses further indemnify Student Bridge against liability arising from their activities (e.g., unlawful rentals, unpaid taxes). This means you must reimburse us for any losses caused by your actions or omissions.
Force majeure: Student Bridge will not be held liable for failing to perform any of its obligations under these Terms if such failure results from circumstances beyond our reasonable control. This includes natural disasters, strikes, war, acts of terrorism, pandemics or public health emergencies, power or internet outages, government actions, or other events commonly defined as “force majeure.” During such events, our obligations will be suspended to the extent and for the duration that performance is made impossible or impractical. We will attempt to communicate with Users and resume operations as soon as feasible. Note that a force majeure event affecting Student Bridge (for example, our site being down due to hosting issues or a cyberattack) does not automatically terminate or change obligations between an Owner and Student under an existing Rental Agreement; those situations are resolved based on the terms of the Rental Agreement or applicable law (for example, local regulations on habitability or doctrines of force majeure affecting the tenancy).
12. Data Protection and Privacy
Compliance with data protection laws: Student Bridge is committed to protecting Users’ personal data in accordance with applicable laws, including the General Data Protection Regulation (GDPR) and Polish data protection laws. By using the platform, you acknowledge that your personal data will be processed in accordance with our Privacy Policy for the purposes of providing the Student Bridge service. The Privacy Policy (available on our website) is incorporated into these Terms by reference.
Personal data we collect: By using Student Bridge, we collect personal data that you provide during registration (such as name, email, phone number, date of birth), profile information, verification documents (e.g., an ID or proof of student status for Students, proof of ownership in the case of Owners), booking information (dates, rental amounts), and payment data (noting that full card numbers are processed securely by our payment provider and not stored by us). We also collect technical data such as IP addresses, device information, and activity logs to ensure security and proper functioning of the platform. This data is necessary for us to provide the service, including verifying identity, ensuring compliance with legal requirements, and facilitating transactions.
Use of personal data: We process personal data to operate and improve Student Bridge, including facilitating bookings, verifying identities, enabling communication and customer support, and fulfilling legal or regulatory obligations (such as record-keeping, fraud prevention, or tax reporting).
We never sell personal data: We share personal data only with service providers performing services for us (supporting the platform’s operation), with your consent, with partners who refer traffic to our site when necessary, or when required by law or legitimate business needs (such as fraud prevention, legal requests, or dispute resolution). We do not sell personal data to third parties for their marketing purposes.
User rights and control: In accordance with GDPR and similar laws, Users have rights regarding their personal data. Subject to certain conditions, you have the right to access information we hold about you (to get a copy of your data), correct inaccurate information, delete data or your account (except information we must keep for legal reasons), restrict or object to certain processing, and the right to data portability. You can view and update basic personal data through your account settings (e.g., updating contact information or profile details). Some sensitive data, such as verification documents (e.g., scanned IDs), are processed directly by our external providers (e.g., Stripe) and not stored by us; if you want to update or remove such information, you must contact us so we can relay your request to the appropriate provider. If you wish to exercise any of your data rights (for example, to access or delete data), you should contact us as directed in the Privacy Policy or via the contact details provided in Section 15(g). We will respond as required by law (usually within one month for GDPR requests).
Data retention period: We retain personal data only for as long as necessary to provide the services or fulfill legal obligations. This includes keeping account data while it is active, storing booking records and financial data for required periods (e.g., under tax laws), keeping verification documents only as long as necessary, and retaining communications for a short time for potential disputes or security purposes. Data is processed securely, and then deleted or anonymized when no longer needed.
Security measures: Student Bridge uses appropriate technical and organizational measures to protect personal data. These include encrypting the website connection (HTTPS), encryption of sensitive fields, firewalls and server monitoring, and limiting access to authorized personnel only. Users must also protect their login credentials (see Section 4(b)). We will inform Users and relevant authorities of any data breaches as required by GDPR if we determine a risk to Users’ rights or freedoms.
Cookies and tracking: Like most websites, Student Bridge uses cookies and similar technologies to enable core functions and improve user experience. For example, cookies allow you to stay logged in while browsing, remember your preferences (e.g., language), and help us understand how the platform is used through analytics. We may also use cookies for marketing purposes (to display our ads on third-party sites to people who visited Student Bridge). Our cookie practices, detailed in the Privacy Policy or on the site, explain which cookies we use and what options you have. Users in the EU will see a cookie consent banner upon first use and can manage their cookie settings (except necessary cookies required for the site’s operation). By continuing to use the site with cookies enabled, you consent to their use as described.
Communications from Student Bridge: By creating an account, you agree that Student Bridge can send you communications electronically, such as emails or platform notifications. These include important account and transaction information (booking confirmations, notices of changes or issues, updates to these Terms or the Privacy Policy, etc.). You cannot opt out of receiving essential service notifications. For promotional or marketing messages, we will send them only if you have signed up or given legally required consent, and you can opt out at any time by clicking the unsubscribe link in such emails or changing your account settings. Even if you opt out of marketing messages, you will still receive transactional communications and those required by law.
Third-party websites: The platform may contain links to third-party websites or services that are not owned or controlled by Student Bridge (e.g., a link to a partner’s service or an external resource). If you click such links, any information you provide to those third parties, or any use of their services, is subject to their own terms and privacy policies, not ours. Student Bridge is not responsible for the content or privacy practices of any external sites.
Contact regarding data protection: Users who have questions or requests about privacy can contact our Data Protection Officer (if one is appointed) or support team as provided in the Privacy Policy. We provide relevant contact information (e.g., an email for privacy inquiries). If you believe that your rights related to data have been violated by our handling of your information, you also have the right to lodge a complaint with the appropriate supervisory authority. In Poland, the competent authority is the President of the Personal Data Protection Office (UODO). Of course, we encourage you to contact us first so we can directly address any concerns.
13. Suspension, Termination, and Account Closure
Account suspension or removal: Student Bridge may suspend or remove accounts at our discretion in cases of violations of these Terms, fraud or illegal activity, providing false information, repeated complaints or cancellations, security threats, or legal compliance issues. Suspension can be temporary during an investigation, but serious or clear violations may result in immediate removal of the account without notice. Typically, Users are informed and may have an opportunity to appeal, but Student Bridge’s enforcement decisions are final to ensure a safe and fair marketplace.
Effects of account removal: If your account is closed, you lose access to the platform and your data, your listings are removed, and upcoming bookings are canceled. Owners will not receive payouts for canceled bookings (and must return any funds already paid out), while refunds for Students will depend on the circumstances and applicable cancellation policies. Legitimate funds due prior to account removal will still be paid out, minus any amounts owed to Student Bridge. You are not entitled to compensation for lost opportunities, and re-registration may be blocked. We may retain certain account data for legal, security, or archival purposes.
Account removal by User: You may close your account at any time, provided you have no active bookings or obligations. Owners must honor or properly cancel existing bookings, and Students must cancel any future bookings in accordance with the refund policies before deleting the account. Closing the account removes your profile and access to the platform, though transaction records may be preserved for legal compliance. Closing your account does not affect any Rental Agreement already signed, which remains binding between you and the other party.
Handling of bookings upon account closure: If an account is closed while a booking is in progress, it will be treated as a cancellation by the responsible party: closing an account by an Owner is treated as an Owner cancellation (with a full refund for the Student), and closing an account by a Student is handled according to the standard cancellation policy (with applicable refunds or forfeitures of payment). If closure occurs after move-in, the Rental Agreement continues outside the platform, since the platform’s role in the transaction has ended. Relevant data may be retained to facilitate resolution of any disputes.
Ban circumvention prohibited: If Student Bridge has suspended or removed your account due to violations or abuse, you are not allowed to create a new account and continue using the service. Any attempts to re-register after a ban, whether by using a different email, name, or false details, constitute a violation of these Terms. If a new account is linked to a previously banned User, it will be closed. However, if you voluntarily closed an account without violations, you may generally register again later if you wish to use the platform again.
Survival of terms after account closure: Certain provisions remain in effect after account closure, including those regarding payments and refunds, liability and indemnification, dispute resolution, governing law, content license, and use of data. These remain enforceable as needed even after you stop using Student Bridge.
14. Governing Law and Dispute Resolution
Governing law: These Terms and any disputes or claims arising out of or relating to them or the Student Bridge services will be governed by Polish law. We choose Polish law because Student Bridge is based in Poland.
Jurisdiction: All legal proceedings related to these Terms or the use of the platform, brought by or against Student Bridge, are subject to the jurisdiction of Polish courts.
Amicable resolution – customer support: We encourage Users to contact our customer support to resolve any concerns or disputes before taking legal action. Often issues can be quickly resolved through the mediation of our support team. If you have a complaint, please contact us (for example, by email or contact form). We will attempt to resolve the issue in good faith. This may involve clarifying misunderstandings, offering a solution such as a partial refund where it aligns with our policies, or indicating next steps.
Alternative Dispute Resolution (ADR) for EU consumers: If a dispute cannot be resolved amicably with our team, EU consumer Users have the right to seek resolution through an alternative dispute resolution body. Student Bridge will provide required information about any ADR entity competent to handle a dispute in our sector. Additionally, EU consumers may use the European Commission’s Online Dispute Resolution (ODR) platform, an interactive website for resolving disputes (available at http://ec.europa.eu/consumers/odr). The ODR platform can facilitate resolution of a dispute with the aid of a neutral ADR body. While we are not obligated to use a specific ADR process in every case, we will participate in the process in good faith if you choose to use it. Please note that ADR and ODR are generally voluntary; both parties must agree to participate. This clause is intended to inform you of your rights and our readiness to cooperate.
Legal costs: In any legal dispute between Student Bridge and a User, the prevailing party is entitled to recover reasonable legal fees and expenses from the losing party.
14. Final Provisions
a. No third-party beneficiaries: These Terms constitute an agreement between you and Student Bridge (and between Student Bridge and each User). No other person or entity has rights under these Terms as a third-party beneficiary. For example, if a Student’s parent or an Owner’s friend is in any way involved, they cannot enforce any provisions of these Terms since they did not agree to them and are not a party to this agreement. Similarly, although a Rental Agreement might benefit a Student’s roommate or an Owner’s co owner, those individuals have no rights or claims against Student Bridge under these Terms.
b. Entire agreement: These Terms, together with our Privacy Policy and any other guidelines or policies we explicitly reference on the platform, constitute the entire agreement between you and Student Bridge regarding your use of our service. They supersede any prior agreements or understandings (oral or written) regarding your use of the platform. This means that if you had any conversations or received any promises about the platform that are not included here or in our official policies, they are not binding. Any changes to this agreement must be made by posting a new version of the Terms by Student Bridge (or in the form of a written amendment signed by Student Bridge). You cannot unilaterally change these Terms.
c. Severability: If any provision of these Terms is found by a court or other authority to be invalid, illegal, or unenforceable, that provision will be limited or removed to the minimum extent necessary, and the remainder of the Terms will remain in full force and effect. In other words, the invalidity of one provision will not render the entirety of the Terms invalid. If possible, the problematic provision will be replaced by a valid provision that most closely reflects the original intent, or it will be enforced to the extent permissible. The aim is to preserve the spirit of the agreement even if some detail must be modified for legal reasons.
d. Assignment of rights and obligations: Users may not transfer their rights or obligations under these Terms to any other person without prior written consent from Student Bridge. For example, you cannot transfer your account to another person, assign your membership, or hand off your obligations here to someone else without our consent. Student Bridge may, however, transfer its rights and obligations to another entity – for example, in the case of a business reorganization, merger, acquisition, or to a subsidiary/affiliate. If we do so, we will ensure that such assignment does not diminish any consumer rights. Any entity that assumes our obligations will honor these Terms with respect to existing Users. Users will be notified if such an assignment occurs.
e. Changes to Terms: Student Bridge may modify these Terms as our business evolves and legal requirements change. If that happens, we will notify Users in advance of the new Terms taking effect, especially if the changes are significant. Notification may occur by email (to the address linked to your account) and/or through a notice on the platform (for example, a banner or pop-up at login). We will give you a reasonable time to review the changes. If you continue to use Student Bridge after the updated Terms take effect, that will constitute acceptance of the changed Terms. If you do not agree to the changes, you must stop using the platform and, if applicable, close your account. Some changes may require you to actively click “accept” to continue using the service, particularly if required by law. Material changes (like changes to fees, cancellation policies, etc.) will be clearly highlighted to ensure you are informed.
f. Language versions: The Student Bridge Terms of Service are available in Polish and English. While we provide the English version for convenience (especially for international Students), the officially binding version of these Terms is the Polish version. In case of any discrepancy or conflict between the English and Polish text, the Polish version will be decisive in the interpretation of the Terms within Poland. Both versions are, however, intended to be equivalent and will be interpreted consistently. Users may request a copy of the Terms in Polish if it is not readily accessible on the platform.
